Welcome to FitHue. These Terms of Service ("Terms") govern your use of the FitHue mobile application and related services (collectively, the "Service").
By creating an account, purchasing or starting a subscription, or otherwise using FitHue, you agree to these Terms. If you do not agree to these Terms, do not use the Service.
1. Use of the Service
FitHue helps users analyze clothing colors, organize activewear and wardrobe information, explore color combinations, and discover color pairing suggestions.
You may use the Service only for lawful purposes and in accordance with these Terms.
FitHue is intended for personal, non-commercial use unless we expressly agree otherwise.
2. Eligibility
You must be at least 13 years old to use FitHue.
If you are under the age of majority where you live, you may use FitHue only with the involvement and consent of a parent or legal guardian.
By using the Service, you represent that you meet these requirements.
3. Accounts
An account is required to use FitHue.
You must provide accurate and complete information when creating your account and keep your account information reasonably up to date.
You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs through your account.
If you believe your account has been accessed without authorization, please contact us promptly.
4. Subscriptions and Payments
Access to FitHue requires an active paid subscription.
FitHue offers subscription options with different billing periods. Certain subscription options may include a free trial. The availability and duration of any free trial will be shown to you before you subscribe.
Subscription prices, billing periods, trial eligibility, and other purchase details are displayed through the applicable app marketplace before you complete your purchase.
Subscriptions are processed and billed by the app marketplace through which you subscribe, such as the Apple App Store or another supported marketplace.
Subscriptions automatically renew at the end of each billing period unless cancelled before renewal in accordance with the rules of the applicable app marketplace.
If you begin a free trial and do not cancel before the trial ends, your subscription may automatically convert to a paid subscription at the price displayed when you subscribed.
You are responsible for managing or cancelling your subscription through the applicable app marketplace.
Deleting your FitHue account does not necessarily cancel an active subscription. You should separately cancel your subscription through the applicable app marketplace if you do not want it to renew.
Refund requests and billing disputes relating to purchases made through an app marketplace are subject to that marketplace's applicable policies and procedures.
Nothing in these Terms limits any refund, cancellation, or other consumer rights that cannot legally be excluded.
5. User Content
You may provide or upload content through FitHue, such as profile images and other information you choose to submit ("User Content").
You retain ownership of your User Content.
You represent that you have the necessary rights and permissions to submit any User Content you provide to FitHue and that your content does not violate the rights of another person or organization.
You may not upload content that is unlawful, harmful, abusive, infringing, or otherwise violates these Terms.
You grant FitHue a limited, non-exclusive license to process, host, reproduce, and otherwise use your User Content only as reasonably necessary to provide, maintain, secure, and operate the Service.
Information about how FitHue collects, uses, stores, and deletes personal information is described in our Privacy Policy.
6. Image and Color Analysis
FitHue may use automated image-processing and related technologies to analyze clothing items and colors and to generate color information, comparisons, and outfit suggestions.
Results are provided for informational and styling purposes only.
Color detection and appearance can vary based on factors such as lighting, camera settings, image quality, display settings, materials, manufacturing variations, and other conditions outside FitHue's control.
FitHue therefore does not guarantee that:
- a detected color will exactly match the physical color of an item;
- two products identified as similar will appear identical in person;
- color names, comparisons, or recommendations will be completely accurate; or
- a suggested color combination will meet every user's personal preferences.
You should use FitHue's analysis and recommendations as a guide rather than as a guarantee of an exact physical color match.
7. Activewear Brands, Colors, and Third-Party Trademarks
FitHue maintains its own database of activewear brands, colors, and related information to provide the Service.
References to third-party brands, products, product names, color names, logos, trademarks, and other identifying information are provided for informational and identification purposes.
All third-party trademarks, brand names, product names, logos, and other intellectual property belong to their respective owners.
Unless expressly stated otherwise, FitHue is not affiliated with, sponsored by, endorsed by, or officially associated with any third-party activewear brand referenced in the Service.
The inclusion of a brand, product, or color in FitHue does not imply any partnership, sponsorship, endorsement, or other commercial relationship with that brand.
8. Prohibited Use
You agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose;
- attempt to gain unauthorized access to another account, system, network, or data;
- interfere with or disrupt the operation or security of the Service;
- upload malicious software, harmful code, or unlawful content;
- use automated systems to scrape, extract, or collect substantial amounts of information from the Service without permission;
- reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service except where applicable law expressly permits it;
- copy, reproduce, distribute, sell, sublicense, or commercially exploit the Service or its content without authorization; or
- use the Service in a way that infringes the intellectual property, privacy, or other rights of another person.
9. FitHue Intellectual Property
The Service and its original content and technology, including its software, design, interface, graphics, features, organization, databases, FitHue branding, logos, and other materials created for FitHue, are owned by or licensed to FitHue and are protected by applicable intellectual property laws.
These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.
Except as expressly permitted, you may not copy, modify, reproduce, distribute, publish, sell, license, or create derivative works from FitHue or its proprietary content without permission.
Nothing in these Terms transfers ownership of FitHue intellectual property to you.
10. Third-Party Services
FitHue may rely on third-party services and technology providers to operate parts of the Service, including services related to hosting, authentication, payments, analytics, or automated processing.
Your use of certain third-party services may also be subject to the terms and policies of those providers.
FitHue does not control third-party services and cannot guarantee their continuous availability or performance.
11. Account Deletion and Termination
You may delete your FitHue account through the Service.
Deleting your account may result in the deletion or loss of information associated with that account, subject to any information FitHue is required or permitted to retain under applicable law or as described in the Privacy Policy.
Account deletion does not necessarily cancel a subscription purchased through an app marketplace. Subscription cancellation must be handled separately through the applicable marketplace.
We may suspend or terminate your access to the Service if you materially violate these Terms, misuse the Service, create security or legal risks, or if we are required to do so by law.
Where appropriate, we may provide notice before suspending or terminating an account.
12. Changes to the Service
FitHue may add, modify, improve, discontinue, or remove features or functionality from time to time.
We do not guarantee that any specific feature, brand, color, database entry, or functionality will always remain available.
Where reasonably possible, we will avoid making changes that unfairly interfere with an active paid subscription, subject to technical, security, legal, or operational requirements.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.
FitHue does not guarantee that the Service will always be uninterrupted, error-free, secure, or available, or that all information, analyses, recommendations, or results will be accurate or complete.
FitHue does not make guarantees regarding the suitability of color recommendations, outfit combinations, or other styling information for any particular user or purpose.
Nothing in these Terms excludes warranties, guarantees, or other rights that cannot legally be excluded under applicable consumer protection law.
14. Limitation of Liability
To the fullest extent permitted by applicable law, FitHue will not be liable for indirect, incidental, special, consequential, or similar damages arising from or relating to your use of, or inability to use, the Service.
FitHue is not responsible for decisions, purchases, styling choices, or other actions made in reliance on color analyses, comparisons, recommendations, or other information provided through the Service.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law or limits any consumer rights or remedies that cannot legally be waived.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
If the law where you live gives you mandatory consumer rights or protections that apply regardless of this provision, those rights and protections remain unaffected.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, our business practices, legal requirements, or other operational needs.
When we update these Terms, we will revise the "Last updated" date at the top of this page.
If changes are material, we will provide additional notice where required by applicable law.
Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
18. Entire Agreement
These Terms, together with any additional terms that expressly apply to the Service, constitute the agreement between you and FitHue regarding your use of the Service.
